What are the mandatory postings in a restaurant and a bar with respect to the labor code ?

If you are the proud owner of a restaurant, bar, club or establishment serving alcohol and/or food, then you are concerned by generic signage. As a manager, director or owner of an establishment, you have certain obligations under the law, the labor code and the health department.

The mandatory regulations concern, first of all, the labor code. Owners of food service establishments are obliged to display the following elements to their employees :

• Occupational Medicine ;
• Collective labour agreement ;
• Collective labour agreement ;
• Collective working hours (individual working hours) ;
• Weekly rests ;
• Paid vacations ;
• Emergency numbers ;
• Emergency Safety Instructions ;

The goal here is that if any employee encounters a difficulty, a particular need or a question, he or she should be able to find an answer and feel secure by referring to these elements. It is therefore your duty as a manager to facilitate access to this information by placing it in a strategic place of passage and accessibility (rest room, locker rooms, ...).

In kitchens, certain safety instructions must be scrupulously respected, especially when handling gas. Highly flammable, it must be handled with care and reflection. That is why these signs are mandatory for its handling:

• Kitchen safety instructions ;
• Gas shut-off valve ;
• Use of gas in collective kitchens.

Since 1991 and the Evin law, the principle of smoking in all premises for collective use has been prohibited and sanctioned. Restaurants and bars being collective use premises, they do not escape the rule and are required to enforce the law. For that, the posting of the text of law in these establishments is obligatory, also, you are held to carry with the glance of your customers and team the following panels :

• No smokin ;
• Prohibition of smoking (more recent than cigarettes, smoking in closed collective places is also prohibited)

In the event of an unannounced or unannounced inspection by the labor inspectorate in your establishment, these elements will have to be posted under penalty of one or several fines.

Mandatory signage for the establishment’s customers:

Your condition as head of an establishment obliges you to post a multitude of essential information for various people. We have seen the compulsory posting of information for employees and now we will see what information you are required to post for your customers.

In addition to displaying the smoking and vaping ban, it is mandatory to display the prices you charge including VAT. This price must include the service and be displayed throughout the service inside and outside.

As you know, as of July 15, 2015, the presence of any allergenic substance on your menu must be listed and displayed in your restaurant.

In addition, the origin of beef and minced meat since 2002, must also be displayed in your establishment.

Mandatory signage for establishments serving alcohol:

If you have a liquor license for your establishment, then a sign will be installed for your customers to see and hear. The sign must mention "the protection of minors and the repression of public drunkenness" and appear near the entrance or your bar if you have one in your establishment.

Is not complying with the mandatory postings serious?

By refusing to comply with the rules relating to the mandatory posting of signs in restaurants, you risk a financial fine. If the refusal persists, you are liable to a criminal fine (art.L81141-1 Code du travail). The fine can range from 450 € to 10 000 €. On the other hand, if the offence is repeated, then the sentence can go up to a fine of 37 000 € and one year of imprisonment.
